Cartage Contractor Chain of Responsibility (CoR) Audit

Chain of Responsibility (CoR) under Heavy Vehicle National Law (HVNL) require that every party in the heavy vehicle transport supply chain has a duty to ensure the safety of persons associated with their transport activities.

Under CoR responsibilities, all parties who influence, direct or control transport operations in the supply chain share responsibility for compliance with the law and for the safety of heavy vehicle operations even if they have no direct role in driving or operating a heavy vehicle.

This responsibility entails an obligation to eliminate or minimize potential harm or loss (risk) by doing all that is reasonably practicable to ensure the safe and legal transport of goods.

To comply with HVNL it is vital the Company Director has documented evidence i.e. (driver induction sign off and signed policies and procedures) etc that clearly demonstrates that ALL reasonable steps have been taken to minimize any risks associated with the operation of a heavy vehicle. 

We provide (CoR) Management Systems that are specifically designed for individual industries, i.e. (Tippers, Tankers, Agi, Waste and Earth Moving Businesses) ensuring they are valid and will immediately fit in with the Company. We provide our services in Queensland (QLD), New South Wales (NSW), Victoria (VIC) and South Australia (SA).

We have designed a comprehensive, user friendly and industry specific CoR Management System that when implemented will ensure Cartage Contractors within the Construction Materials industry will have all of the tools necessary to meet their obligations under CoR legislation.

In the event of an incident where someone is hurt or killed by the Heavy Vehicle the Director would be expected to provide evidence that they have taken ALL reasonable steps to minimise risk in their business.

 

Have you taken reasonable steps?

Under the Heavy Vehicle National Law (HVNL), you are considered to have complied with your COR obligations so long as you have taken ALL reasonable steps or undertaken ALL that was reasonably practical to prevent a breach. You must also demonstrate that you did not know or could not have known that a breach occurred.

Courts will recognise that the duties of parties are personal responsibilities, which cannot be delegated to others. Every person in the chain must satisfy themselves that every vehicle, every load and every driver is compliant with the law on every journey.

In the majority of cases, for a defence to be successful, ALL reasonable steps must have been taken, not just some.
